Mandatory Declarations Under the International Air Cargo ICS2 System: What New Data Elements Must Cross-Border Sellers Provide?

The EU’s ICS2 system has now fully entered its mandatory implementation phase, completely replacing the traditional ENS declaration model and instituting proactive, granular data controls for all air cargo entering the EU. Compared to maritime and rail transport, air cargo is the sector most directly affected by these new regulations and subject to the strictest enforcement; specifically, an Entry Summary Declaration (ENS) must be completed 24 hours before cargo is loaded onto an aircraft. Any data errors, omissions, or incomplete information will directly result in cargo being refused for loading, detained at the airport, or even subject to substantial administrative fines. For cross-border e-commerce sellers, familiarizing themselves with the new declaration elements required for air cargo under ICS2—and refining their documentation submission processes accordingly—is an essential prerequisite for complying with regulatory rules and ensuring the smooth shipment of their goods.

The core changes introduced by the new ICS2 regulations center on three key dimensions: proactive data submission, enhanced data precision, and comprehensive accountability tracking. Information that was previously optional or discretionary is now strictly mandatory; the standard six-digit HS code has been upgraded to a more precise eight-digit code; and details regarding cargo descriptions, consignor/consignee information, and compliance credentials must now be specified with the utmost granularity. Furthermore, should customs clearance be obstructed due to erroneous declaration data, the seller, freight forwarder, and carrier will all be held jointly and severally liable for any resulting penalties. To ensure compliant customs clearance, sellers must first clearly identify the four major categories of newly required declaration elements and systematically address any gaps in their documentation.

Information regarding the consignor, consignee, and the declaring entity constitutes the first category of newly mandatory data elements. The EU consignee’s valid EORI number is no longer an optional field but a strictly mandatory requirement; it must align exactly with the information on file with customs authorities, and system declarations cannot be successfully submitted without a valid, compliant EORI number. Consignor and consignee addresses must be specified in minute detail—including street name, house/building number, postal code, and precise city. For corporate recipients, the tax ID and contact details must be provided; for individual recipients, comprehensive identity verification details must be submitted. Additionally, complete information regarding the “Notify Party” must be supplied. In scenarios involving multi-layered freight forwarding chains or multi-tiered Bill of Lading structures, the registration details of all intermediary agents and the carrier codes must be fully declared to ensure a complete and traceable chain of accountability.

The declaration requirements for basic cargo information have also undergone a comprehensive upgrade. There is now a unified requirement to declare precise 8-digit HS codes; for shipments containing multiple SKUs, each individual item must be assigned a unique code—multiple items may not share a single code. Product descriptions must strictly avoid vague or ambiguous phrasing; instead, they must explicitly specify the material, brand, model, specifications, and intended use. Even unbranded goods must be clearly labeled as such, eliminating the use of generic terms such as “accessories,” “samples,” or “general merchandise.” The country of origin must be specified precisely—regional collective terms are no longer acceptable substitutes. Additionally, details regarding packaging type, piece count, gross weight, volume, and standard shipping marks must be fully declared; shipments lacking specific marks must be clearly indicated in accordance with regulatory standards. For every individual SKU, the quantity, net weight, unit price, and total value must be itemized separately to ensure that the shipment details are clear, transparent, and fully verifiable.

Compliance certifications and brand-related credentials have become mandatory prerequisites for air freight declarations. Products containing batteries or power sources require the entry of a UN38.3 test report number; chemical products must be accompanied by the relevant compliance codes and safety instructions; and categories such as toys and cosmetics require the registration of pertinent CE certification details. Branded goods mandate the declaration of the brand authorization certificate number and the details of the authorizing entity; shipments lacking formal authorization must be truthfully declared as “unbranded” to avoid triggering intellectual property infringement risk alerts. Furthermore, high-value shipments must specify the applicable trade terms (Incoterms) and reference the associated sales contract and invoice numbers to facilitate rapid valuation and verification by customs authorities.

Several new mandatory fields have also been introduced regarding logistics and transportation details. It is now mandatory to fully declare the flight number, departure time, origin airport, and destination airport, as well as to clearly identify the carrier’s registration number. For consolidated (LCL) shipments, the container number and seal number must be accurately reported; in multi-tiered Bill of Lading (B/L) scenarios, the B/L number and cargo ownership details for each hierarchical level must be fully recorded. This ensures that the entire logistics chain is fully traceable from end to end, thereby meeting the big data risk screening requirements of the ICS2 system.

To ensure a smooth transition and full compliance with the mandatory ICS2 declaration requirements, cross-border sellers should undertake three key preparatory measures. First, establish a proprietary product information database wherein every SKU is pre-assigned its corresponding 8-digit HS code, standardized product description, country of origin, and compliance certification documentation, thereby enabling one-click data retrieval and standardized declaration filing. Secondly, strictly control document consistency to ensure that all critical information—across invoices, packing lists, customs declarations, and cargo manifests—is uniform, thereby preventing data conflicts that could trigger system interceptions. Thirdly, coordinate in advance with a professional freight forwarder; allow ample time prior to cargo loading for a preliminary review of documentation, enabling the early rectification of issues such as missing elements or data errors, and preventing cargo rejections or delays.

The new ICS2 regulations mark the European Union customs’ official entry into an era of digitized and precision-driven risk management. The introduction of additional declaration data points is not merely about increasing procedural complexity; rather, it represents a comprehensive upgrade in the compliance management capabilities required of sellers. Only by proactively mastering these regulations, refining documentation systems, and standardizing declaration procedures can sellers mitigate declaration risks at the source, ensure the smooth customs clearance of air freight shipments, and successfully cultivate their presence within the EU cross-border market.
